Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Laksana platform, website, dashboards, helpdesk portals, public pages, share links, and related services (“Laksana”, “Service”), operated by Delyva Sdn Bhd (1362081-M) (“we”, “us”, “our”).
By accessing or using Laksana, you agree to be bound by these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
1. About Laksana
Laksana is a WhatsApp-first operations platform that helps organisations receive updates through WhatsApp and web-based channels, track work updates and problem reports, manage compliance and preventive maintenance records, store evidence, and generate operational dashboards, reports, and shared views.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. If you use Laksana for an organisation, you must have authority to act on that organisation’s behalf.
3. Account Registration, Invites, and Organisation Access
To use Laksana, you may need to create an account, accept an invite, or access a workspace through an authorised onboarding flow.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity carried out under your account
- Ensuring your team uses the Service only as authorised
- Managing roles, permissions, invite links, public sharing settings, and organisation structure within your workspace
Organisation administrators may control user access, linked channels, locations, permissions, shared links, and workspace settings across one or more related organisations.
4. Use of the Service
You agree to use Laksana only for lawful business or operational purposes and in compliance with applicable laws and regulations.
You must not:
- Use the Service for illegal, harmful, misleading, or fraudulent activity
- Upload malware or attempt to disrupt the platform
- Access or attempt to access data belonging to another organisation without permission
- Upload content that infringes privacy, confidentiality, intellectual property, or other rights
- Share invite links, public links, or helpdesk access in a way that exposes information to unauthorised parties
- Rely on Laksana as an emergency dispatch or life-critical response system
5. Messaging, Helpdesk, and Third-Party Platforms
Laksana may integrate with third-party channels and service providers, including WhatsApp, cloud hosting, payment processors, and AI providers.
You acknowledge that:
- Delivery, availability, and functionality may depend in part on third-party providers
- We do not control outages, delays, policy changes, or limitations imposed by those providers
- You are responsible for complying with the applicable third-party terms and policies
6. Customer Data and Content
You retain ownership of the data, messages, photos, files, and other content submitted to Laksana by you or your users (“Customer Content”).
By using the Service, you grant us a limited right to host, process, transmit, analyse, store, display, and share Customer Content solely as needed to provide, secure, support, and improve the Service.
You are responsible for ensuring you have the necessary rights and permissions to submit Customer Content, including any photos, personal data, site information, geolocation data, or other materials uploaded through WhatsApp, helpdesk portals, share links, or the dashboard.
7. AI-Assisted Processing
Laksana may use automated systems and AI models to help classify messages, photos, and submissions, create operational records, assist with routing, and improve reporting. These features are provided to support the Service, but you remain responsible for reviewing outputs and decisions made by your organisation based on those outputs.
8. Public Links, Shared Pages, and Direct Record Access
Some accounts may enable shareable links, public helpdesk pages, or direct record pages that can be accessed without a full account login. If you create, distribute, or enable those features, you are responsible for:
- Verifying the shared content is appropriate
- Limiting distribution of the link or page
- Disabling access when it is no longer needed
- Managing internal permissions and organisation settings that affect visibility
9. Subscription, Trials, Billing, and Credits
- Subscription fees are billed according to the selected plan, order form, or pricing agreed with you
- Free plans or trials may be offered with usage, feature, or time limitations
- Plans may include limits based on locations, users, residents, records, notifications, credits, or other usage measures
- You may upgrade, downgrade, or cancel according to your plan terms
- Fees are non-refundable unless required by law or otherwise agreed in writing
- We may change pricing or plan features with reasonable notice
10. Service Availability
We aim to keep Laksana available and reliable, but the Service is provided on an “as is” and “as available” basis.
We do not guarantee:
- Uninterrupted or error-free operation
- Continuous availability of third-party integrations
- That the Service will meet every specific operational, compliance, maintenance, or reporting requirement
11. Limitation of Liability
To the maximum extent permitted by law, Delyva Sdn Bhd shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business opportunities, or goodwill
- Issues arising from third-party integrations, external platforms, or customer misuse of the Service
Our total liability for claims arising out of or relating to the Service shall not exceed the fees paid by you for the Service in the 12 months preceding the event giving rise to the claim.
12. Suspension and Termination
We may suspend or terminate access to the Service if:
- These Terms are breached
- The Service is misused
- Required payments remain overdue
- We are required to do so by law or by a third-party platform dependency
You may stop using the Service at any time. Suspension or termination does not relieve you of payment obligations already incurred.
13. Data Access After Termination
After termination or cancellation, access to the Service may end immediately or at the end of the current billing period, depending on your plan. We may retain or delete Customer Content in accordance with our retention practices, legal obligations, and any agreed export arrangements.
14. Intellectual Property
Laksana and its related software, branding, content, and platform materials remain our property or the property of our licensors. These Terms do not transfer any ownership rights in the Service to you.

16. Indemnification
You agree to indemnify, defend, and hold harmless Delyva Sdn Bhd (1362081-M), its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees, including reasonable legal fees, arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your Customer Content
- Your violation of any law or the rights of another person or organisation
This indemnification obligation survives termination of your account or these Terms.
17. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised last updated date. Continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Malaysia.
