operated by Delyva Sdn Bhd (1362081-M) (“we”, “us”, “our”).

By accessing or using Laksana, you agree to be bound by these Terms. If you do not agree, please do not use the
Service.

1. About Laksana

Laksana is a WhatsApp-based operations platform that helps organisations track work updates, report problems, manage
evidence, and generate operational reports.

2. Eligibility

You must be at least 18 years old and have the authority to bind your organisation to use the Service.

3. Account Registration

To use Laksana, you may be required to create an account and provide accurate information.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities performed under your account
• Ensuring authorised use by your team members

4. Use of the Service

You agree to use Laksana only for lawful business purposes and in compliance with all applicable laws and
regulations.

You must not:

• Use the Service for illegal, harmful, or fraudulent activities
• Upload malicious code or attempt to disrupt the platform
• Access data belonging to other organisations without permission
• Misuse messaging channels (including WhatsApp) in violation of platform rules

5. Messaging & Third-Party Platforms

Laksana integrates with third-party messaging platforms such as WhatsApp.

You acknowledge that:

• Messaging delivery depends on third-party providers
• We do not control outages, delays, or limitations of those platforms
• You are responsible for complying with WhatsApp’s terms and policies

6. Data & Content

You retain ownership of all data, messages, photos, and content submitted to Laksana.

By using the Service, you grant us a limited licence to process and store your data solely for the purpose of
providing the Service.

7. Subscription, Trials & Billing

• Subscription fees are billed according to your selected plan
• A free trial may be offered under specific limitations
• You may upgrade, downgrade, or cancel according to plan terms
• Fees are non-refundable unless required by law
• We reserve the right to change pricing with reasonable notice

8. Service Availability

While we aim for high availability, Laksana is provided on an “as-is” and “as-available” basis.

We do not guarantee:

• Uninterrupted or error-free service
• That the Service will meet all specific business requirements

9. Limitation of Liability

To the maximum extent permitted by law, Delyva Sdn Bhd shall not be liable for:

• Indirect or consequential damages
• Loss of profits, data, or business opportunities
• Issues arising from third-party integrations

Our total liability shall not exceed the fees paid by you in the preceding 12 months.

10. Termination

We may suspend or terminate access if:

• These Terms are breached
• The Service is misused
• Required by law

You may stop using the Service at any time.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Malaysia.

13. Indemnification

You agree to indemnify, defend, and hold harmless Delyva Sdn Bhd (1362081-M), its affiliates, officers, directors,
employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees
(including reasonable legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your Customer Content, including claims that you did not have the rights or permissions to submit such content
• Any photos, data, or information you upload or share through the Service

This indemnification obligation will survive termination of your account or these Terms.
