Terms of Service

Please read these Terms of Service carefully before using the Laksana platform. By accessing or using Laksana, you agree to be bound by these terms. If you do not agree, do not use the platform.

1. Service Provider

Laksana is operated by DELYVA SDN. BHD. (Company No. 202001005761 / 1362081-M), incorporated in Malaysia. For enquiries, contact us at hello@laksana.ai.

2. Account Registration

You must provide accurate and complete information when registering an account. You are responsible for maintaining the security of your login credentials and for all activities that occur under your account. You must notify us immediately if you suspect unauthorised access. One workspace account may be used by multiple authorised members within the limits of your subscription plan.

3. Acceptable Use

Laksana is designed for facility and operational management. You agree not to: upload malicious software or harmful content; attempt to bypass subscription limits or PII scrubbing mechanisms; use the platform to send spam or unsolicited communications; impersonate another user or workspace; or engage in any activity that violates applicable laws or regulations.

4. Subscriptions & Billing

Subscriptions are billed per workspace per site per month (or per year for annual plans) via Stripe. Plans are defined by member seats, site limits, and feature availability. Upgrades take effect immediately. Downgrades and cancellations take effect at the end of the current billing period. If payment fails, access may be restricted to Free plan limits until payment is resolved. No refunds are provided for partial billing periods unless required by applicable law.

5. Data Ownership

You retain full ownership of all data you submit to Laksana, including operational records, photos, and team data. You grant Laksana a limited licence to store, process, and display this data solely for the purpose of providing the platform's features to you. We do not claim any ownership over your content and do not use it for any purpose beyond operating the platform.

6. AI Features & Consent

Laksana includes optional AI-powered features. AI processing of messages is subject to your workspace's explicit consent, which can be enabled or disabled at any time via Workspace Settings. When AI is enabled, PII (emails, phone numbers, names) is automatically scrubbed before submission to remote AI endpoints. You may disable AI processing at any time without affecting core platform functionality.

7. WhatsApp Integration

Laksana's WhatsApp features operate via the WhatsApp Business API, governed by Meta's Terms of Service and Business Policy. You are responsible for ensuring your use of WhatsApp-based features complies with applicable regulations, including obtaining necessary consents from your team members to receive WhatsApp notifications from Laksana.

8. Limitation of Liability

Laksana provides tools to assist with operational management but does not guarantee zero downtime, error-free performance, or specific business outcomes. To the maximum extent permitted by law, DELYVA SDN. BHD. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to data loss, revenue loss, or operational disruptions.

9. Termination

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or fail to pay subscription fees. Upon termination, your data will be retained for the period specified in our Privacy Policy and then permanently deleted. You may also request account deletion by contacting hello@laksana.ai.

10. Governing Law

These Terms are governed by the laws of Malaysia, including the Personal Data Protection Act 2010 (PDPA). For users in the European Union, GDPR obligations apply in addition to these terms. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. If you are an EU data subject, you also retain the right to escalate privacy concerns to your local data protection authority.

11. Modifications & Contact

We reserve the right to update these Terms at any time. Material changes will be communicated by updating the date on this page or via in-app notifications. Continued use of the platform after such changes constitutes your acceptance. For questions, contact DELYVA SDN. BHD. at hello@laksana.ai.
